Renting a Home in Antalya as a Foreign Tenant

Turkish tenancy law gives residential tenants strong protection, but only if they know the rules. Before signing, and during the lease, keep in mind:

• Deposit: it may not exceed three months’ rent, and a cash deposit is placed in a savings account that cannot be withdrawn without the landlord’s consent (Code of Obligations art. 342).
• Extra charges: a tenant cannot be required to pay anything other than rent and service charges, and penalty clauses for late payment are invalid (Code of Obligations art. 346).
• Rent increases: a renewal-year increase is capped by the consumer price index; after five years the judge may set a new rent based on comparable rents (Code of Obligations art. 344).
• End of the term: the lease extends automatically for one year unless the tenant gives notice fifteen days before the end, and the landlord cannot rely on the end of the term alone (Code of Obligations art. 347).
• Written notices: notices of termination must be in writing to be valid (Code of Obligations art. 348).
• Late rent: if rent is unpaid, the landlord must give a written deadline of at least thirty days before terminating (Code of Obligations art. 315).
• Getting the deposit back: if the landlord has not told the bank within three months after the lease ends that they have sued or started enforcement, the bank returns the deposit on the tenant’s request (Code of Obligations art. 342).

Which Courthouse Hears Cases from Muratpaşa?
